EB-5 Investment Amount (2026): $1,050,000 and $800,000 Explained
Updated 2026-11-07 · Citizenships.ai editors
The US EB-5 program grants permanent residence (a green card) to investors who fund a new commercial enterprise that creates at least 10 full-time US jobs. This guide summarizes what USCIS publishes. It is not legal or immigration advice.
The current amounts
For petitions filed on or after 15 March 2022, USCIS lists:
- US$1,050,000 standard minimum investment.
- US$800,000 in a targeted employment area (TEA) or an infrastructure project.

Ignore the $1.8 million figure
A 2019 rule raised the amounts to US$1.8 million and US$900,000, but a federal court vacated that rule in June 2021. USCIS's Policy Manual says it does not apply the vacated amounts to any petition. Some pages still show them.
What is a targeted employment area?
A TEA is either a rural area or an area with unemployment of at least 150% of the national average. Since 2022 the Department of Homeland Security designates high-unemployment TEAs itself.

USCIS says the amounts will be adjusted for inflation every five years, with the first adjustment for petitions filed on or after 1 January 2027. The Regional Center Program is authorized through 30 September 2027.
